In Kansas "sex crimes" range from sexual acts, sexual abuse and sexual exploitation. POTENTIAL CONSEQUENCES FOR KANSAS SEX CRIMES
You are facing aggressive investigation and prosecution, and the penalties are severe, for all Kansas state sex crimes. Life imprisonment without the possibility of parole, and lifetime registration as a sex offender are real possibilities in some sex crime cases.

The sentencing grid below divides crimes by severity level (the vertical axis of the grid, numeric levels), and
categorizes you by your prior criminal records (the horizontal axis, levels A-I).

Kansas sex offenses (i.e. non-drug crimes) are divided into severity levels 1-10.

Your criminal history designations, level A is the most serious, if you have three or more convictions for “person” felonies (crimes committed against people). Level I is the least serious designation, if you have no criminal record or only one misdemeanor conviction.

Some crimes in Kansas are called "off-grid felonies". Most off-grid felonies are very serious crimes, punishable by the death penalty or life imprisonment. For example, if you are charged with rape of a child that is an off-grid felony, it is punishable by life in prison.

KANSAS SEX CRIMES INVESTIGATION

From the initial report though prosecution, Kansas law enforcement have set of guidelines they follow. The beginning steps are: 
  • Alleged victim contacts law enforcement. This will prompt dispatch of an officer;
  • Responding officer will use "trauma-informed" interviewing to collect the report of a sex crime;
  • Formal/Follow-up interview of alleged victim typically occurs;
  • A victim advocate will likely be assigned. The prosecution realizes alleged victims are more likely to participate in your investigation and prosecution if given an advocate;
  • Applicable special agencies will be involved (ex. Child Protective Services);
  • Blood and urine samples, of the alleged victim, will be taken (where drugs/alcohol are suspected components of crime);
  • A sexual assault medical examination will be conducted of alleged victim (i.e. rape kit);
  • Then you will be contacted. Beware that law enforcement is trained to make certain assumptions and collect information that you may not have considered, as follows:
  1. Your course of conduct. They will be looking for what you did before and after the alleged crime (i.e. what you said, communications had, your behavior, etc.) in search of planning and/or grooming you may have done;
  2. Your prior criminal history (reported and unreported). Law enforcement are trained that it is likely that you have committed other similar/parallel crimes (ex. domestic violence, sex crimes, strangulation, stalking, etc.) and will ask you about those, and pull your criminal history prior to contacting you;
  3. You will be considered a perpetrator. For that reason they will be looking for you to display entitlement, power, control and manipulation. They will want to know of your ability to victim identify (vulnerable, intoxicated, mentally ill, young, etc.) and your attempts to discredit the alleged victim;
  4. Your defenses will be picked apart. Law enforcement are told the common defenses  are denial, mistaken identity and consent. You may give evidence against yourself if you: disclose that sexual activity occurred (no matter how little), give evidence that links you to the alleged victim, and/or help to show lack of consent (i.e. coercion, force, threat, compliance or submission); and
  5. Digital evidence will be requested. Investigators will ask you for, and will check, your digital communication (ex. social media, recordings, messages, internet search history, etc.). Further, they will be making contact with other agencies who can collect this information without your help.
  • A narrative report will be made and a Sex Assault Supplement Report Form will likely be attached;
  • Officers are trained that a sex crime report is valid unless evidence collected shows otherwise. ​Even if you are not arrested immediately after speaking to law enforcement the narrative report and supplemental evidence (lab results, witness statements, etc.)  will be provided to the Kansas prosecutor for review. 
  • Law enforcement may then contact you again, to fill in any blanks (as requested by the district attorney). In the alternative the prosecutor will note the charge as "unfounded" or will find probable cause to seek warrant for your arrest.
As you can see, the sex crimes investigation process if often long and complex. Studies show that only a small percentage of sex crime cases reported are considered "unfounded" during the investigatory stage.
