Should you be found guilty, in Kansas, a sentencing system will be used to determine your consequences. The court will consider the seriousness of the crime and your prior record. You could then receive anything from probation to imprisonment. To make informed decisions, the court will conduct a pre-sentencing investigation. 

Presentencing Report
This report will be heavily relied upon, when the court makes its sentencing decisions. Within it may be:
  • Any of your prior convictions;
  • Facts surrounding any prior crimes;
  • A classification (using the severity scale) for each crime;
  • Risk assessment (Level of Service Inventory - Revised report);
  • Drug & alcohol report; and
  • A psychological examination.
This information will be used to determine what you will be sentenced to in this current case. You will be afforded the opportunity to respond to the information in the report. 

Investigation
To ensure that there is an unbiased report, the court will assign the task of fact gathering to an outside party.  You should know, that during the investigation stages, the officer can contact you, witnesses, victims, etc. You do not have the right, like during depositions, to be present during those conversations. An important part of the final report is the criminal history worksheet. To be considered, generally, are your convictions (not to include traffic tickets), only similar/related diversion pleas. Additionally your basic background information will be gathered - date of birth, SSN, address, employment, family history, your connections to the community, etc. 

As noted above, part of the investigation may be into your mental health, drug and alcohol concerns. Any statements made during these examination can be used to determine your ultimate sentence and any treatment you may need. 

Submitting The Report

With all of the investigation results in hand, the officer will provide a final report to the court. It is part of the public information with only certain sections kept private (ex. your SSN). Your lawyer and the DA will have the opportunity to challenge the information but, the final decision will be that of the judge's. 

Remember: You do not have the same protections as you do do when investigations occur as part of your trial (ex. Miranda Rights). You should not give statements, or fill out documents, related to your sentencing without attorney advise.
