OVERLAND PARK MUNICIPAL COURT

If you have been charged with a crime within the limits of Overland Park you will be appearing in its local municipal court. This court will hear any matters involving a violation city ordinances, such as:

Overland Park’s municipal court is located one block east of Blue Valley Parkway, off of 123rd and Foster Street in south central Overland Park. The court encompasses the majority of the Sanders Justice Center. The Court is attached to the Overland Park Police Headquarters. Those in custody can appear via video conference.

Prosecutor
The arm of the Overland Park City Attorney’s office that prosecutes crime in known as the city prosecutor’s office. The city prosecutor’s office is housed in the Sanders Justice Center on the second floor of the courthouse. The city prosecutor’s office is tasked with both making charging decisions and prosecuting alleged criminal acts. City prosecutors follow the case to District Court in the case of an appeal. Overland Park currently has three full-time prosecutors and one part-time prosecutor.

Court Clerk
The administrative arm of the Overland Park Municipal Court is vested in the court clerk’s office. The Court clerk’s office makes up a large part of the first floor of the courthouse. The court clerk’s office keeps the court’s schedule, accepts monies on behalf of the court, schedules meetings for the probation office and performs many other essential functions for the court. There are well over a dozen assistant court clerks employed by the court clerk’s office.

Appealing 
The defendant may appeal so long as they do so within 14 days of sentencing in a municipal court. To begin this process you must file a notice of appeal with the municipal court and pay an appeal bond.

​Obtaining Discovery On An Overland Park Case
If you are accused of a crime in Overland Park you are entitled to conduct discovery in the matter. You are afforded the same constitutional protections as depicted in Brady vs. Maryland when it comes to discovery. You are entitled to view all evidence that the city intends to use against you at trial as well as all evidence the city has or can reasonably obtain that tends to prove you did not commit the offense as well. In other words, you get to see everything. Like most municipal courts Overland Park has a specific process that a defendant must go through to obtain discovery. You can request discovery by going to the police station located in the Sanders Justice Center and filling out a form with the police records unit. There is a small fee to produce the evidence in any given case.
