TYPES OF CRIMES & DEFENSES
In Kansas, it is in this phase where cases may be won or lost. If you hesitated, or delayed, in retaining counsel before, don't do it at this point. The discovery phase is where you are notified of the evidence that will be used against  you. Combing through this information is tedious, to say the least. 

The District Attorney must share with you the evidence that may prove that you committed a crime and any evidence that may prove that you didn't. Yes, they must disclose both. To get this process started, you must request it from the DA.  While some of the evidence may be in written form (ex. reports, test results, etc.) most of it will be in the form of physical evidence. Therefore, you must view it at the DA's office, police station, etc. While there may be witnesses (and statements from them) shared with you, no witness must talk directly to you or your attorney during this phase. 

The evidence collected by law enforcement or the DA will be used against you. Here the DA is only looking for enough evidence to convince a judge that: a) the crime was committed, and b) you committed it. It will be up to your attorney to show the court that here are inconsistencies and/or weaknesses in the known information. 

You should know that not all evidence can be used against you. That is because you have rights surrounding the collection of it, such as:
  • Unlawful or warrantless search/seizures
  • Evidence was discovered during/after an unlawful arrest
  • Failure to be Mirandized, and more
Once you reach this stage it is critical that an experienced attorney review the case against.  It won't just go away. At this point, it will end in one of four ways - by the state, by the court, plea agreement or trial.  Quick resolve, in your favor, is unlikely; especially without an attorney.
