 You've been injured in a Kansas accident, at no fault of your own. You expect to be justly compensated for your damages. You file a claim with the insurance company and patiently await your check. Unfortunately, it is unlikely that getting the money you deserve will be that easy. Even highly successful attorneys must often fight to get what is fair for their clients. We thought you should know the top 10 tactics used to avoid paying you. After all, knowledge is power.
  1. Pretending to be working for you and promising to get you what is "fair". Never forget that the insurance company is not your friend and will work tirelessly to underpay you ALWAYS;
  2. Discouraging you from getting a lawyer. They know that when you retain an attorney you are likely going to get 3 times more. That is a statistical fact;
  3. Recording your statements. It may seem harmless (since you are telling the truth and have nothing to hide) but, the statements you make will likely be used against you later to reduce or deny you payment;
  4. Speedy Settlement for "full release of liability". Quick acceptance of payment and a release of liability will ensure that the insurance company cannot be later held liable for your long term damages they otherwise would have been responsible (ex. future medical care);
  5. Delaying payment. This tactic is used in an effort to frustrate you, make you desperate for relief, make you fearful and/or overall take advantage of your unexpected situation. If they can push you into a corner you are more likely to settle for less;
  6. Conducing surveillance/ investigation. If they suspect that you may be exaggerating your damages or have been untruthful the insurance company may have you tailed and/or double-check all statements you have made. They have also been known to use this technique to strike fear in you too;
  7. Failing to fully disclose policy coverage. If you don't know what is in the policy you don't know what you are entitled to. You are only entitled to a copy of the policy through litigation;
  8. Denying your claim. The insurance company may outright deny your claim; thereby, forcing you to litigate it in court and foot the bill for your care/damages in advance;
  9. Asking you for authorization to get all of your records (medical, drug, mental health, etc...). If they can find anything, at all, in your records that can shift the fault of the accident back to you, they will not hesitate to do so. You should NEVER give unbridled access to your records;
  10. Denying your claim because of pre-existing injury. Again, saving money and shift the blame is a game the insurance company loves;
