Today’s blog topic is how you’re going to pay for an attorney if you’ve been injured in a car accident. Let me help address your concern.  Attorneys who represent injury victims, and I, typically do not charge any fees upfront. Your consultation is free. Additionally, during the claim, we cover the expenses related to preparation for settlement/trial, to include:
  • Expert witness fees;
  • Filing fees;
  • The costs for production of documents; etc...
Reimbursement of costs and/or attorney's fees are collected when we recover for you. This is known as a contingency fee. Handling accident claims this way began years ago. It was created, in an effort, to give everyone the opportunity to be represented (regardless of their financial or social status). 

How are the charges, for a car accident attorney, calculated then? No upfront costs means you don't have to worry about paying an hourly rate along the way. The attorney's fees in Kansas are typically one-third to fifty percent of your award amount, depending on the type of case and its complexity. You might wonder if hiring a lawyer, after a car accident, is really worth it. Today we are going to discuss the benefit of hiring an attorney vs. facing the insurance company alone. 

Frequently accident victims think they can resolve their claim alone. They assume they can save the fee for having a lawyer and, get it done quicker and faster. In fact, the insurance company will feed you information to make you believe that this mindset is accurate. In a few instance this may be true. Beware, that those cases are few-and-far-between! Most lawyers, handling car accidents, will provide you with a free evaluation and tell  if you might be able to handle the claim yourself. 

Most of the time though, it is best to get an attorney right away. Here are a few reasons why:
  • Lawyers have access to experts who can provide an accurate determination of what you are entitled to;
  • Attorneys know what can be deducted from compensation and what cannot;
  • Timely resolution of your claim increases three-fold when you have an attorney;
  • Receipt of medical care and car repairs are typically more thorough where a lawyer is involved;
  • Insurance companies will have lawyers. So should you.; and
  • You are responsible for getting better and an attorney takes care of the rest.
If those reasons weren't enough, statistics show that injury victims that hire lawyers, on average, receive three and one-half  times more money. It pays to have a lawyer.

You’ve been in a car accident in Kansas and you want to know how long it’s going to take to handle your claim. I’m Attorney T. Morton and we are going to discuss what amount of time it can take. The quick answer is, it depends.

The time it will take to resolve your claim depends on a number of things, to include:

Why are photographs worth everything to your accident case? As cliche as it may be, a picture is worth a thousand words. Photographs are important because each is able to accurately portray immediate injury. This captures the pain, the scene, the depth of the damage, etc...that would otherwise be gone because you healed, had surgery, got your car fixed, received treatment and so on. Having such photos, should your claim go to trial, also provides the jury an opportunity to go back to the moment with you. Thus making you, your pain/suffering, the impact the car accident has had on your life, the shock and devastation experienced, etc...understandable.
